Florida Health Co. Sues Ex-Director Over Trade Secrets


On Tuesday a case was filed in the Middle District of Florida by Premise Health Holding Corporation against Erica L. Thomas. The case is regarding theft of trade secrets.

The plaintiff, the complaint explained, is a corporation that provides on worksite health services such as primary and preventive care and wellness coaching. The defendant was employed by the plaintiff as the Senior Director of Client Operations, specifically responsible for the company’s contract with the Walt Disney Company.

At the initial hiring, as well as during annual in-house training, the defendant signed a contract regarding the Premise Health code of conduct, which included a restriction on the use and sharing of trade secrets.

According to the complaint, the defendant left the plaintiff to join Emsana Health Inc. and as a part of that process, developed potential PowerPoint presentations and resources for her future work while on the clock of her current employer, the plaintiff. Thomas also allegedly used trade secrets specific to the plaintiff and especially to the Walt Disney Company contract. The materials used included performance information, videos, and other information that was not publicly available and was only accessible to the defendant due to her employment.

The plaintiff is suing for trade secret misappropriation, breach of duty of loyalty, and breach of contract. The plaintiff seeks preliminary and permanent injunctive relief regarding the trade secrets. Premise is represented by Bradley Arant Boult Cummings LLP.
