Energetix Corporation, a homeopathic remedy business, filed a complaint against Energetix Health Inc., alleging the defendant engaged in trademark infringement and unfair competition.
On September 5th 2001, the plaintiff filed a federal trademark application for their marks. The plaintiff has developed and maintained customers throughout the United States through the use of their marks.
According to the complaint, the defendant violated the plaintiff’s trademark registration by using the Energetix name as a website name and in association with providing goods and services. The plaintiff notified the defendant on April 12, 2021 by email. The complaint alleges that the defendant’s use of the Energetix trademark and tradename has caused confusion and deception to consumers which causes harm to the plaintiff’s business.
The plaintiff seeks the following for relief: an enjoinment of the defendant from using the Energetix mark, an order for the defendant to deliver all infringing products and advertisements for destruction, and an award of damages and costs.
